Mr J was walking with his brother-in-law, and his brother-in-law’s dog, when the dog, a King Charles Spaniel, suddenly spotted a fox and bolted. His brother-in-law didn’t have a proper grip of the lead and the lead became entangled in Mr J’s legs, tripping him up and pulling him over. Mr J hit the ground hard, badly fracturing his knee in the process.
Mr J was a driver by trade and was unable to work as a result of his injuries. He therefore contacted our specialist animal injury team about claiming compensation for his injury and loss of earnings. The dog was insured, so we took on his case and presented a claim to the insurance company on his behalf.
Liability was initially denied by the insurance company on the basis that what happened could not have been predicated and the accident was unforeseeable. However, we successfully argued that the King Charles Spaniel breed of dog was bred for hunting and it therefore should have been known that this dog would be likely to bolt after a fox.
The insurance company backed down and the claim was settled out of court, with Mr J receiving compensation for his injuries.
